Congressmen Ted Lieu (D-CA) and Senator Ed Markey (D-MA) introduced a bill last September that would require a Congressional declaration of war before first-use of nuclear weapons would be allowed. I don’t think that’s necessarily the right approach (Congress has not issued a declaration of war since World War II, so this is effectively just a prohibition on first-strike capability, which will lead the military, defense establishment, and most security scholars I know to definitively oppose the idea), but I hope that this might serve as a place to revisit and discuss these issues formally in a legislative setting. I am not convinced I have the perfect policy solution, but for me an idealized law would have provisions that allowed for first-use in emergency circumstances, with at least one other human being (preferably more, though not an impractical number) having to actively agree with the order (and having veto power over it). I think this is a rather modest suggestion. It would not completely rule out first-strike possibilities — nothing would, save lack of nuclear capability altogether, and that’s a separate can of worms — but it would allow the American people, military, and political establishment to know that no single human being would be shouldering that responsibility alone.

Documents suggest Palantir could help power Trump’s ‘extreme vetting’ of immigrants

Palantir, the data-mining firm co-founded by tech billionaire and Trump transition adviser Peter Thiel, has provided largely secret assistance to the US Customs and Border Protection agency (CBP) in operating a system that tracks and assesses immigrants and other travelers, according to public records. Known as the Analytical Framework for Intelligence, the system draws from a variety of federal, state, and local law enforcement databases that gather and analyze often-sensitive details about people, including biographical information, personal associations, travel itineraries, immigration records, and home and work addresses, as well as fingerprints, scars, tattoos, and other physical traits.

CBP lends out access credentials for the Analytical Framework for Intelligence (AFI) to other law enforcement agencies, including the Immigration and Customs Enforcement’s office of Enforcement and Removal Operations, the country’s primary deportation force. Though little is understood by the public, the Palantir-linked system could represent a powerful and far-reaching tool in Trump’s quest to limit migration into the country.

“When Trump uses the term ‘extreme vetting’, AFI is the black-box system of profiling algorithms that he’s talking about,” says Edward Hasbrouck of the Identity Project, a civil liberties initiative that focuses on the rights of travelers. “This is what extreme vetting means.”

Dozens of heavily redacted references to Palantir appear in AFI documents that the Electronic Privacy Information Center obtained through a lawsuit.

Several professors I spoke to say that officials who work for the government’s science departments are privately imploring researchers outside the government to download what they can now, or risk losing access to it later. NOAA and the EPA did not respond to a request for comment. A spokesperson for NASA told me the agency is “apolitical” and that it is “committed to doing whatever we can to assist in making the Executive Branch transition a smooth transition.”

Those rights are inherent in us because we are humans, not because they are granted by government. The heads of the Pentagon and the nation’s intelligence community have recommended to President Obama that the director of the National Security Agency, Adm. Michael S. Rogers, be removed.

The recommendation, delivered to the White House last month, was made by Defense Secretary Ashton B. Carter and Director of National Intelligence James R. Clapper Jr., according to several U.S. officials familiar with the matter.

Action has been delayed, some administration officials said, because relieving Rogers of his duties is tied to another controversial recommendation: to create separate chains of command at the NSA and the military’s cyberwarfare unit, a recommendation by Clapper and Carter that has been stalled because of other issues.

The news comes as Rogers is being considered by President-Elect Donald Trump to be his nominee for DNI, replacing Clapper as the official who oversees all 17 U.S. intelligence agencies. In a move apparently unprecedented for a military officer, Rogers, without notifying superiors, traveled to New York to meet with Trump on Thursday at Trump Tower. That caused consternation at senior levels of the administration, according to the officials, who spoke on the condition of anonymity to discuss internal personnel matters.
